Participant Terms

These Participant Terms apply to any person who purchases one or more squares in a fundraiser conducted through the Lucky Squares Australia platform. Please read these terms carefully before completing your purchase.

1. Who You Are Dealing With

When you purchase a square in a fundraiser conducted through the Lucky Squares Australia platform, you are participating in a fundraising activity organised and operated by the Organiser (the community group, sporting club, or charity that created the fundraiser). Your purchase of a square and participation in the Fundraiser are transactions with the Organiser, not Lucky Squares Australia.

Play With Heart Pty Ltd ACN 698 202 069 ABN 19 698 202 069 (trading as Lucky Squares Australia) provides the software platform only. It is not the organiser, operator, or promoter of any fundraiser conducted through the Platform.

2. Your Purchase

2.1By purchasing one or more squares, you are paying the Organiser for the chance to win a prize in a randomised draw conducted by the Organiser using the Lucky Squares Australia platform.
2.2The price per square, prize structure, draw method, and closing date are set by the Organiser and displayed on the fundraiser page. Lucky Squares Australia does not set or guarantee these details.
2.3Your purchase does not guarantee that you will win a prize.
2.4Each square is allocated a unique number between 1 and the grid size. Square numbers are assigned sequentially in the order they are selected.
2.5A maximum number of squares may be purchased per person per transaction, this is 10 for a Casual Standard or Blitz grid, or 25 for a Casual Premium grid (The Big One or The Mega Big One), as shown on the fundraiser page.

3. Reservation and Checkout

3.1When you select squares, they are temporarily reserved for you for 7 minutes while you complete your details and payment.
3.2Squares reserved by you will appear green on the grid and will be visible to other visitors as reserved (shown in orange with a countdown timer) during this period.
3.3If you do not complete your purchase within 7 minutes, your reservation will expire and your squares will be released back to the grid for others to purchase.
3.4Your reservation timer is paused while you are actively in the checkout process and resumes if you navigate away from checkout without completing your purchase.

4. Payment

4.1Payment instructions are provided at checkout. Depending on the fundraiser, payment may be collected in person by the Organiser (cash or EFTPOS), by bank transfer to the Organiser's nominated account, or by secure online card payment.
4.2For card payments, a payment-processing fee is added to the transaction. The applicable fee is displayed before payment is confirmed and is used to offset Stripe's payment-processing costs. Lucky Squares Australia does not retain this fee as revenue. No processing fee applies to bank transfer or in person payments.
4.3Your square(s) will be confirmed once payment is received by the Organiser. Questions concerning receipt of payment, square confirmation, refunds or charges imposed by the Organiser should be directed to the Organiser in the first instance. Questions concerning a suspected Platform or payment-processing error may also be reported to Lucky Squares Australia.

5. The Draw

5.1Winners are selected using the randomised draw functionality provided through the Lucky Squares Australia platform.
5.2A draw can only be initiated by the Organiser. Lucky Squares Australia does not independently initiate, schedule or determine whether a draw takes place.
5.3The Organiser must conduct the draw in accordance with the Fundraiser Terms displayed to Participants, applicable legislation and any permit conditions.
5.4Draw results are final, subject to any remedy required by applicable law or necessary because of a verified material technical error affecting the integrity of the draw.

6. Prizes

6.1Prizes are paid by the Organiser, not by Lucky Squares Australia, within the period required by applicable legislation, any permit conditions and the Fundraiser Terms displayed to you, or otherwise within a reasonable period after the draw.
6.2Prize amounts displayed on the fundraiser page are set by the Organiser. Where a 100 Club prize split is selected (where available), prize amounts shown are estimates based on squares sold and will be confirmed following the close of the fundraiser.
6.3If you win a prize, you will be notified by email and provided with instructions for claiming your prize from the Organiser.
6.4Prize claims must be made in accordance with any instructions provided by the Organiser. Lucky Squares Australia is not responsible for unclaimed prizes.

7. Refunds and Cancellations

7.1Refunds are managed by the Organiser, not by Lucky Squares Australia.
7.2The Organiser may cancel, postpone, vary or draw an undersold fundraiser only where this is permitted by applicable law, any permit conditions and the Fundraiser Terms displayed before purchase. If a fundraiser is lawfully cancelled before the draw, the Organiser is responsible for ensuring that all affected Participants receive the refunds required by the Fundraiser Terms and applicable law.
7.3Nothing in these Participant Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other legislation where doing so would be unlawful. To the maximum extent permitted by law, Lucky Squares Australia is not responsible for an Organiser's failure to conduct a Fundraiser, provide a refund or provide an advertised prize, except to the extent that the relevant loss was caused or contributed to by Lucky Squares Australia's own breach, negligence, unlawful conduct, fraud or wilful misconduct.

8. Your Personal Information

Your name, phone number, and email address are collected when you purchase a square. This information is used to:

  • Confirm your square allocation
  • Notify you of the draw result
  • Contact you if you win a prize

Your information is handled in accordance with the Lucky Squares Australia Privacy Policy. Your details will be shared with the Organiser for the purposes of running the fundraiser.

9. Eligibility

By participating in a fundraiser through the Lucky Squares Australia platform, you confirm that:

  • You are at least 16 years old. If the Fundraiser offers alcohol, tobacco, gambling products or any other prize that cannot lawfully be supplied to you, you must be at least 18 years old to enter. The Fundraiser's terms, permit conditions or applicable law may set a higher minimum age than this
  • Your participation is permitted under the laws of your state or territory
  • You are not participating on behalf of a syndicate or commercial enterprise unless disclosed to the Organiser

A prize that cannot legally be supplied to a minor will not be awarded directly to one.

10. Complaints

If you have a complaint about a fundraiser, please contact the Organiser in the first instance. If you believe the Platform has been used unlawfully, you may contact Lucky Squares Australia. Lucky Squares Australia will cooperate with any relevant regulatory authority investigation.

11. Governing Law

These Participant Terms are governed by the laws of South Australia, Australia.
