These Terms of Service (“Terms”) govern your use of the Lucky Squares Australia platform (“Platform”). By creating an account as an Organiser or launching a fundraiser through the Platform, you agree to be bound by these Terms.

1. About Lucky Squares Australia

Play With Heart Pty Ltd ACN 698 202 069 ABN 19 698 202 069 (trading as Lucky Squares Australia) (“we”, “us”, “our”) is a software-as-a-service platform that provides digital tools enabling community organisations to conduct grid-based fundraising activities. We are based in South Australia, Australia.

Lucky Squares Australia provides software and sharing tools through which Organisers make their Fundraisers available to Participants. Each Fundraiser is created, offered, promoted and conducted by its Organiser. Lucky Squares Australia does not independently determine whether a Fundraiser is offered, who it is offered to, its prize structure, or whether its draw proceeds.

2. Definitions

"Platform"
means the Lucky Squares Australia website, software, and associated services available at luckysquares.com.au.
"Organiser"
means any individual, incorporated association, registered charity, or community organisation that creates an account and launches a fundraiser on the Platform.
"Participant"
means any person who purchases one or more squares in a fundraiser conducted through the Platform.
"Fundraiser"
means a grid-based lucky squares fundraising activity created and operated by an Organiser using the Platform.
"Campaign Fee"
means the fee charged by Lucky Squares Australia to the Organiser for access to the Platform tools required to create and manage a Fundraiser.
"Casual Standard"
means a Fundraiser of up to 100 squares, launched by an Organiser without an Organisation plan, for a one-off Campaign Fee.
"Casual Premium"
means a larger single-grid Fundraiser (currently, The Big One or The Mega Big One) or a Lucky Squares Blitz event, launched by an Organiser without an Organisation plan, for a one-off Campaign Fee.
"Square"
means a numbered grid position within a Fundraiser that a Participant may purchase for the opportunity to win a prize.

3. Eligibility

To use the Platform as an Organiser, you must:

  • Be at least 18 years of age (see Section 5.7 for the position on people aged 16 or 17)
  • Be fundraising on behalf of, or in connection with, a club, school, charity, community group, or other community organisation; OR be an individual with a community-connected fundraising purpose as described in Section 6.1
  • Where acting on behalf of an organisation, have authority to bind that organisation to these Terms
  • Not be using the Platform for personal commercial gain
  • Ensure your fundraising activity is legally permitted in your jurisdiction

Lucky Squares Australia may refuse access where it reasonably believes that a person or organisation is ineligible, presents a legal, regulatory, fraud, security or material reputational risk, or intends to use the Platform inconsistently with these Terms or its community-fundraising purpose.

4. Campaign Fee and Payment

4.1
The Campaign Fee is charged to the Organiser at the time of launching a Fundraiser. Current fees are:
Casual Standard (per campaign, up to 100 squares)$19.00 AUD

4.2
The Campaign Fee is processed securely via our online payment provider and is charged in Australian dollars inclusive of GST where applicable. The Organisation plan fee listed above is an introductory price.
4.3
The Campaign Fee is non-refundable once a Fundraiser has been launched, except where required by Australian Consumer Law.
4.4
Lucky Squares Australia reserves the right to amend Campaign Fees at any time. Amended fees will not apply to Fundraisers already launched prior to the fee change.
4.5
The Campaign Fee covers access to the Platform software tools only. It does not guarantee any particular outcome, number of participants, or funds raised.
4.6: Card Payment Processing Fee
For card payments, a payment-processing fee is added to the transaction. The applicable fee is displayed before payment is confirmed and is used to offset Stripe's payment-processing costs. Lucky Squares Australia does not retain this fee as revenue.

5. Organiser Obligations

5.1: Regulatory Compliance

The Organiser is the promoter of the Fundraiser and is responsible for conducting it and satisfying all legal, licensing, permit and conduct requirements applying to it.

The Organiser must determine whether it is eligible to conduct the Fundraiser, obtain any required permits or authorities, comply with all applicable conduct conditions and ensure the Fundraiser Terms are accurate and lawful.

5.2: Permits and Authorisations
Where required by applicable law, the Organiser must obtain all necessary permits, approvals, or authorisations from the relevant state or territory gaming authority before launching a Fundraiser. The Organiser is solely responsible for determining which exemption (if any) applies to their Fundraiser, meeting all applicable conduct conditions (including audience, pricing, timing, prize limits, and record-keeping), and obtaining and verifying all required permits. Any prize thresholds or guidance referenced on the Platform, including on our Raffle Compliance page, are provided for general reference only. Falling under a stated threshold does not, by itself, mean a Fundraiser is compliant, permit-free status also depends on organisation eligibility and the specific conduct rules that apply in that jurisdiction. Lucky Squares Australia does not obtain, verify, or guarantee the existence of any such permits. Lucky Squares Australia is not responsible for loss arising from the Organiser's failure to obtain or comply with a required permit or authority, except to the extent that the loss was caused or contributed to by Lucky Squares Australia's own breach, negligence, unlawful conduct, fraud or wilful misconduct.
5.3: Accurate Information
The Organiser must ensure that all information provided on the Platform, including campaign descriptions, prize amounts, draw rules, and payment instructions, is accurate, truthful, and not misleading.
5.4: Prize Payment
The Organiser is solely responsible for providing all advertised prizes to winners within the period required by applicable legislation, any permit conditions and the Fundraiser Terms. If none specifies a period, prizes must be provided within a reasonable period after the draw. Lucky Squares Australia does not fund or provide prizes.
5.5: Participant Communications
The Organiser is responsible for all communications with Participants regarding the Fundraiser. Confirmation of participation and draw result notifications are sent by the Platform on the Organiser's behalf and at the Organiser's direction, using contact details Participants provided at checkout. The Organiser remains solely responsible for ensuring Participants are properly notified and for the accuracy of the underlying Fundraiser information.
5.6: Fund Management
Where the Organiser collects participant payments directly (in-person or direct deposit payment campaigns), the Organiser is solely responsible for the collection, holding, and disbursement of all funds in accordance with applicable law. Participant funds are not beneficially held by Lucky Squares Australia.
5.7: Age Restrictions

Participants must be at least 16 years old. Participants under 18 may not enter a Fundraiser offering alcohol, tobacco, gambling products or any other prize that cannot lawfully be supplied to them. A Fundraiser's terms, permit conditions or applicable law may impose a higher minimum age.

Organiser account holders must be at least 18 years old and authorised to act for the relevant organisation. People aged 16 or 17 may assist an organisation with campaign administration where permitted, but cannot hold the Organiser account or accept these Terms on the organisation's behalf.

A Fundraiser offering alcohol or another age-restricted prize must be restricted to Participants aged 18 years or over. The Organiser is solely responsible for obtaining any required liquor licence or authorisation, verifying the winner's age and ensuring the prize is lawfully supplied. Alcohol must not be supplied to, collected by or delivered to a person under 18.

A person conducting or managing a Fundraiser must not participate in it where the applicable jurisdiction prohibits this. A prize that cannot legally be supplied to a minor must not be awarded directly to one.

5.8: Our Own Obligations
The Organiser is responsible for conducting the Fundraiser and satisfying all legal, licensing, permit and conduct requirements applying to it. Lucky Squares Australia remains responsible for its own obligations as provider of the Platform and does not exclude any responsibility that cannot lawfully be excluded.
5.9: Cancellation, Postponement and Undersold Fundraisers
The Organiser may cancel, postpone, vary or draw an undersold Fundraiser only where this is permitted by applicable law, any permit conditions and the Fundraiser Terms displayed before purchase. If a Fundraiser is lawfully cancelled before the draw, the Organiser is responsible for ensuring that all affected Participants receive the refunds required by the Fundraiser Terms and applicable law.

6. Permitted and Prohibited Uses

6.1: Platform purpose
Lucky Squares is designed for community fundraising: campaigns run by or on behalf of clubs, schools, charities, community groups, or individuals with a community-connected purpose. A community-connected purpose includes fundraising by an individual who is raising money in connection with a recognised community organisation or group activity (for example, a club member raising funds to attend a representative sporting event on behalf of their club).
6.2: Prohibited campaign purposes

The following campaign purposes are not permitted on the Platform, regardless of the worthiness of the cause:

  • Personal medical expenses, cancer treatment, or ongoing health costs
  • Funeral or burial expenses
  • Personal financial hardship, rent assistance, or debt relief
  • Any campaign where the primary beneficiary is an individual with no community-connected purpose

For campaigns of this nature, platforms such as GoFundMe, MyCause, or Chuffed may be more appropriate.

6.3: Prohibited content and conduct

You must not use the Platform to:

  • Conduct fundraising activities that are unlawful in your jurisdiction
  • Promote, facilitate, or benefit illegal activities
  • Raise funds in connection with adult content, pornography, or sexually explicit material
  • Raise funds for gambling-related activities, tobacco, or recreational drugs
  • Misrepresent the nature, purpose, or prize structure of a Fundraiser
  • Collect participant funds without the genuine intention of conducting a draw and paying prizes
  • Conduct fundraisers for personal commercial profit
  • Impersonate another organisation or individual
  • Promote discrimination, harassment, or vilification of any person or group
  • Circumvent, disable, or interfere with the security features of the Platform
  • Use the Platform in any way that violates these Terms or applicable law

7. Intellectual Property

7.1
All intellectual property in the Platform, including software, design, trademarks, and content created by Lucky Squares Australia, remains the sole property of Lucky Squares Australia.
7.2
Organisers retain ownership of content they upload to the Platform, including campaign descriptions, logos, and images. By uploading content, Organisers grant Lucky Squares Australia a non-exclusive licence to display that content on the Platform for the purposes of providing services to the organiser.
7.3
Organisers must not upload content that infringes the intellectual property rights of any third party.

8. Limitation of Liability

8.1
To the maximum extent permitted by law, Lucky Squares Australia's aggregate liability arising out of or in connection with the Platform is limited as follows:
  • for a Fundraiser purchased individually on a casual basis, whether Casual Standard or Casual Premium, to the Campaign Fee paid for the affected Fundraiser; and
  • for a Fundraiser provided as part of an Organisation plan without a separate Campaign Fee, to the Organisation plan fee paid by the Organiser for the membership period in which the event giving rise to the claim occurred.
8.2
Where multiple claims arise from the same or substantially related circumstances, those claims will be treated as a single claim and will not give rise to multiple liability caps.
8.3
These limitations do not apply to liability that cannot lawfully be limited or excluded, or to loss caused by Lucky Squares Australia's fraud, wilful misconduct or unlawful conduct.
8.4
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other legislation where doing so would be unlawful.

9. Service Availability

9.1
Lucky Squares Australia does not warrant that the Platform will be continuously available, uninterrupted or free from every error. Availability may be affected by maintenance, telecommunications or power failures, internet disruption, third-party service-provider outages, cyber incidents and other circumstances outside Lucky Squares Australia's reasonable control.
9.2
To the maximum extent permitted by law, Lucky Squares Australia is not liable for delay, interruption or failure caused by circumstances outside its reasonable control, provided that Lucky Squares Australia has taken reasonable steps appropriate to the nature of the Platform to select and manage its service providers, protect Platform security, maintain reasonable business-continuity arrangements and respond to the incident.
9.3
Nothing in this section excludes any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

10. Draw Integrity

If a verified technical error materially affects square allocation, payment status or the integrity of a draw, Lucky Squares Australia may temporarily suspend the affected result while the issue is investigated. Lucky Squares Australia will work with the Organiser to identify a lawful and proportionate remedy. A draw will not be re-run merely because an Organiser or Participant is dissatisfied with the result.

11. Indemnity

The Organiser indemnifies Lucky Squares Australia against third-party claims, regulatory penalties and reasonable costs to the extent caused by the Organiser's unlawful conduct, breach of these Terms, inaccurate or misleading Fundraiser information, failure to obtain a required permit or authority, or failure to provide an advertised prize.

This indemnity does not apply to the extent that the relevant loss was caused or contributed to by Lucky Squares Australia's breach of these Terms, negligence, unlawful conduct, fraud or wilful misconduct.

12. Termination

12.1
Lucky Squares Australia may suspend or terminate access where it reasonably believes that the Organiser has breached these Terms, created legal, regulatory, fraud, security or material reputational risk, failed to pay an amount due, or used the Platform in a manner inconsistent with its intended community-fundraising purpose. Where reasonably practicable, Lucky Squares Australia will provide notice and an opportunity to remedy the issue. Lucky Squares Australia may suspend access immediately where reasonably necessary to protect Participants, funds, Platform security or legal and regulatory compliance.
12.2
Suspension or termination does not remove the Organiser's outstanding obligations to Participants, including its obligations relating to refunds, draws and prizes.
12.3
Campaign Fees may remain non-refundable where suspension or termination results from the Organiser's breach of these Terms. If Lucky Squares Australia ends access for reasons unrelated to the Organiser's conduct, Lucky Squares Australia will provide any refund or credit required by law and may provide a reasonable pro-rata refund or service credit.

13. Amendments

Material changes to these Terms apply prospectively and will not alter the rules or fees of a Fundraiser already launched unless the change is required by law or agreed with the Organiser. Lucky Squares Australia will provide reasonable notice of material changes where practicable.

14. Fair Play

14.1: One account per organisation
The Organisation plan is available to individual community organisations only. Each organisation may hold one Organisation plan account. The plan is not transferable to, and may not be shared with, affiliated entities, member clubs, branches, or any other organisation, regardless of any formal relationship between those entities.
14.2: Umbrella organisations
A state-based body, league, association, or governing body may not purchase a single Organisation plan and extend its benefits to member clubs or affiliated organisations under its umbrella. Each individual club, school, or charitable entity that wishes to access the Organisation plan must hold its own account and pay the applicable annual fee.
14.3: ABN verification
We verify the Australian Business Number (ABN) provided at registration. By submitting an ABN, the Organiser confirms that the ABN belongs to the organisation for which the account is being created. Providing an ABN that belongs to another entity, or using an Organisation plan for an entity other than the registered organisation, constitutes a material breach of these Terms and may result in suspension or termination in accordance with Section 12.
14.4: Our intent
The Organisation plan is priced to make ongoing fundraising accessible and affordable for genuine community organisations. We ask that Organisers honour the spirit of this pricing. Lucky Squares Australia reserves the right to investigate suspected misuse and to take appropriate action, including account suspension or termination, where misuse is identified.

15. Governing Law

These Terms are governed by the laws of South Australia, Australia. Each party submits to the non-exclusive jurisdiction of the courts of South Australia for the resolution of any dispute arising under or in connection with these Terms.

16. Testimonial Prize Draw (discontinued)

The Testimonial Prize Draw previously offered by Lucky Squares Australia has been discontinued and is no longer running. No further entries are being accepted and no further draws will be held. This section is retained for the reference of past entrants and winners only.
